Connect the photo brief to the delivery agreement

A photography brief should lead to an agreement about both the shoot and the delivered images. This PDF and DOCX outline separates coverage, editing, selection and usage rights so neither party has to infer them from a package name. It is a sample for attorney review.

Inside the downloadable sample

  • Creative brief and shoot coverage
  • Location access and people in frame
  • Selection, retouching and delivery files
  • Image rights and permitted uses
  • Shoot changes and project payment
  • Archive expectations and project close

The PDF and editable DOCX contain the sample clauses and blank agreement fields. Microtra does not generate contracts.

How to use the template.

  1. Write the shoot brief and the delivery specification as separate attachments.
  2. List the client's intended image uses before discussing licensing with counsel.
  3. Have a qualified attorney in your state review rights, releases, revisions and payment provisions.
  4. Retain the reviewed agreement alongside location approvals, the final brief and delivery correspondence.

Useful answers.

Does paying for a shoot automatically transfer copyright?

Do not assume a transfer. Describe the intended uses and ask a qualified attorney to draft the appropriate license or ownership terms for the commission.

Should raw files be included in every package?

State your actual delivery policy. Edited images, raw captures and complex retouching are different deliverables and should be discussed before the shoot rather than inferred afterward.

How can additional image requests be handled?

Use a clear selection and extra-work process. Record the requested images or editing, the proposed charge and the revised delivery arrangement before accepting more production work.
